1. Agreement to these terms

This website is operated by Penny Faye ("we," "us," "our"). By visiting our site or purchasing from us, you agree to these Terms of Service, including any additional terms and policies referenced here.

If you do not agree to these terms, please do not use this site.

We reserve the right to update or change any part of these terms by posting updates to this page. Continued use of the site after changes are posted constitutes acceptance of those changes.

3. Eligibility

You must be at least 18 years old, or the age of majority in your state, to purchase from this site. By placing an order you represent that you meet this requirement and that the information you provide is accurate.

Our products are designed to be worn by children, but they may only be purchased by an adult.

4. Products and product information

We make every effort to display our products, materials, and dimensions accurately. Screen colors vary, and product photography — including renderings — may not exactly match the item you receive.

Our silver pieces are solid 316L stainless steel. Our gold pieces are 316L stainless steel finished with an 18k gold PVD coating. PVD is a vacuum-bonded surface finish, not solid gold, and we describe it as such throughout this site.

Products are offered subject to availability. We reserve the right to limit quantities, discontinue any product, and refuse any order at our discretion.

5. Product safety and intended use

Our Mini pieces are intended for children and must be used with adult supervision. Please read our Sizing & Safety guidance before your child wears one.

You are responsible for ensuring the piece fits correctly and for checking that fit regularly as your child grows. A bangle loose enough to slide over the hand can catch on furniture, car seats, cribs, or play equipment. We recommend removing a child's bangle during unsupervised sleep and during climbing or playground activity.

The age guidance we publish is a general average, not a guarantee of fit for any individual child. You know your child best, and final judgment about whether and when a piece is appropriate for them rests with you.

6. Pricing and payment

All prices are listed in US dollars and are subject to change without notice. We reserve the right to correct pricing errors, including after an order has been placed; if we do, we will notify you and give you the option to confirm the corrected order or cancel it for a full refund.

Payment is processed at checkout by our payment provider. We do not store your full payment card details.

Applicable sales tax is calculated and displayed at checkout.

7. Orders and cancellation

Receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability. If we cancel an order after payment, we will refund you in full.

If you need to change or cancel an order, contact shop@pennyfaye.com as soon as possible. We ship quickly — often the same day — so we cannot guarantee we can make changes before dispatch.

8. Shipping

We currently ship within the United States only.

Delivery estimates provided at checkout are estimates supplied by the carrier and are not guaranteed. We are not responsible for carrier delays, weather delays, or delivery issues once a package has left our possession, though we will always help you trace a package that has gone missing.

Risk of loss passes to you upon delivery to the carrier.

9. Returns and refunds

Returns are governed by our Refund Policy, which forms part of these terms.

10. Warranty and disclaimer

Our solid 316L stainless steel pieces carry a lifetime guarantee against tarnishing, rusting, and discoloration, as described in our Refund Policy. This guarantee does not cover wear to the gold PVD finish, accidental damage, scratches, pieces deformed by repeated adjusting, or loss and theft.

Except for that express guarantee, and except where prohibited by law, our products and this site are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Penny Faye is not liable for any indirect, incidental, punitive, or consequential damages arising from your use of this site or our products.

Where liability cannot be excluded, our total liability is limited to the amount you paid for the product giving rise to the claim.

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.

Some states do not allow certain limitations of liability, so parts of this section may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Penny Faye and its officers, employees, and suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these terms or your violation of any law or the rights of a third party.

13. Intellectual property

All content on this site — including text, photography, product designs, the Penny Faye name, and our logo — is our property or used with permission, and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use it commercially without our written permission.

14. Content you submit

If you submit reviews, photographs, comments, or other content to us or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business, including in marketing.

You represent that you own or control the rights to any content you submit, that it does not violate anyone's rights, and — where it depicts a child — that you are that child's parent or legal guardian and consent to its use.

We may remove any submitted content at our discretion.

15. Privacy

Your use of this site is also governed by our Privacy Policy.

16. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising under these terms will be brought in the state or federal courts located in Walton County, Florida, and you consent to the jurisdiction of those courts.

17. Severability

If any provision of these terms is found to be unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force.

18. Entire agreement

These terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and Penny Faye regarding your use of this site.
